Loper: A coalition of 18 conservative organizations led by Americans for Prosperity is calling on Congress to take advantage of the Supreme Court's ruling Loper Bright Enterprises v. Raimondo – which scuttled the Chevron Doctrine – to take steps to curb the reach of the administrative state. "In overturning Chevron, the Supreme Court affirmed Congress’s exclusive authority to make law, restoring the appropriate separation of powers as established by the constitution," the groups said. In particular, they said the new GOP-controlled Congress should use the Congressional Review Act "to roll back Biden-Harris regulations – especially through the expected midnight rules process during lame duck – to prohibit agencies from implementing similar regulations in the future." They also called for passage of the REINS Act, which would require Congress to approve major federal agency rules and rules with an impact of $100 million or more before they take effect. "These policies are essential. However, more will be needed to achieve the goal of putting elected officials, not bureaucrats, in charge of our governance," the conservative coalition said.
